the full High Court judgement in favour of the Free Speech Union

Further to my email yesterday about the comprehensive win we achieved this week in the High Court, the full judgement (reasons) came through last night and are available to read here.

Given the current cancel culture and suppression of opposing opinions, the Judge’s comments are extremely encouraging. It is especially pleasing to see the Judge apply what we’ve previously achieved in the Court of Appeal (against Auckland Council/Phil Goff) as the basis of his decision to reinstate the Speak Up for Women event.

This win is a very strong shot across the bows of all Councils and Mayors who may try to limit free speech. We will stand up for free speech, and win.

I am told that last night’s Speak Up for Women event in Palmerston North went ahead without incident. Despite the social media mob’s shouting, no one was hurt in the exercise of free speech or by the feminist group voicing their opinions.

But Hate Speech laws are the next big fight

The Government appears determined to go ahead with the criminalisation of so called “hate speech” – despite the Minister’s’ definitions of what they do, and don’t, want the law to cover remaining vague.

The consultation on the draft law runs until early August. That means we have a window of opportunity to blow the whistle on this dangerous proposal. We will be ensuring it is easy for New Zealanders to have their say, and planning our campaign in the coming few days.

WHO Official says Mask Mandates & social distancing should continue indefinitely

A top WHO official says that mask mandates and social distancing should continue indefinitely in order to protect against new variants of cv-19.

The comments were made on Sky News by Special Envoy on Covid for the World Health Organisation (WHO). Dr David Nabarro.

Nabarro suggested that there would be a long list of mutations of the Indian variant which would in some cases evade the protection offered by vaccines.

“We will go from Delta to Lambda and then on to the other Greek letters, that’s inevitable, and some of these variants will be troublesome,” he said.

“I’m basically saying variants are going to go on coming. That’s part of life, we need to pick them up fast, we need to move quickly if we see them in a certain location, we need to build the management of variants into what we call our Covid-ready strategy, which is going to be the pattern for the foreseeable future,” he added.

According to Nabarro, mask mandates and social distancing need to remain in place for the foreseeable future “as part of our defence” against cv, particularly in regions which have high infection rates.

As we highlighted earlier, England is set to drop all face mask rules on July 19 after it was revealed that they were having a massive negative impact on businesses and wiping billions off the economy.

Several government advisers have called for coronavirus restrictions to continue forever, not just to defend against cv, but also to fight influenza.

Former Communist Party member and SAGE adviser Susan Michie said earlier this month that mask mandates and social distancing should continue “forever” and that people should adopt such behaviour just as they did with wearing seatbelts.

National confirms it will fight Labour’s attacks on Freedom of Speech

Freedom of speech is a fundamental right

The National Party believe that freedom of speech is a fundamental right, National’s Justice spokesperson Simon Bridges says.

“We completely oppose the criminalising of speech except in cases of incitement to violence which is already provided for in New Zealand Law.

“We are not ruling out supporting sensible changes to the Human Rights Act 1993 like perhaps updating the groups covered by anti-discrimination law, but we would need to see the law in writing before taking a conclusive position. In any case, Minister Faafoi’s proposed Hate Speech law changes seek to change a lot more.

“The Prime Minister has already begun mischaracterising the proposed law changes by framing them as simply adding ‘religion’ as a protected group in light of the Royal Commission. I encourage all New Zealanders to read the 6 proposals for themselves because these laws reach much further than that.

“The National Party encourages open debate and discussion as this leads to people being better informed and able to form their own opinions. Democracy relies on the ability of people to speak freely and in turn others are, of course, free to disagree.

“Protecting free speech does not mean that there isn’t speech that I find abhorrent. We are all offended by a variety of things. However, it would be complete overreach to criminalise people, throw them in jail for up to three years, because they caused offence.

“This Government, unable to deliver on much else, appears to want to regulate New Zealanders in every facet of our lives. Not content with just telling us what car we are allowed to drive, they want to restrict and regulate the words that come out of our mouths.

“This is Orwellian and the National Party will oppose such a complete encroachment on our rights.”

the Free Speech Union has a victory against Palmerston North City Council

I have some great news — we have achieved a compressive victory against Palmerston North City Council who tried to de-platform the feminist group Speak Up for Women because the Council did not like their views.

This afternoon, the High Court granted the injunction Speak Up for Women sought (and we have been supporting) and has ordered the Council to host the event, as it was planned, tonight at 6.30 in the Palmerston North Library.  

Meanwhile, in Auckland, Speak Up for Women settled with Auckland Council and the event will go ahead on Sunday. We supported this decision. During the legal proceedings, it was disclosed by Auckland Council that they had identified a unique critical risk with the event proceeding at the original location of the Ellen Melville Centre. At this stage we can’t go into precise details of that (the Court has suppressed the particular risk).

But given this risk, Speak Up For Women agreed to the Council’s offer of the new location. The Council will also be issuing a public statement before 5 pm today which in and of itself will be a win compared to how they have previously treated freedom of speech. 

You can read the Court’s decision here. The reasons will follow (likely next week) and you’ll be the first to get them. 

Thank you to all who have chipped in to support this effort. Only with the support of thousands of New Zealanders can we stand up to defend free speech and put the would be censors on the back foot, like they are today.
